When you choose to purchase our product you are subject to the following terms and conditions. We advise you to please read these conditions carefully prior to purchase, as once items have been bought, you are agreeing to abide by these terms:

Privacy

Personal Details – Any personal information that you provide to us including your name, address, telephone number and email address will not be released, sold or rented to any entities or individuals outside of Quiet Earth.

Security

Quiet Earth does not collect or record any credit card details you may provide when purchasing products from our website. Your credit card details are processed by third party payment authorities PayPal and Stripe.

Pricing

All pricing is in Australian Dollars (AUD) and Quiet Earth reserves the right to change pricing at our discretion and without notice.

Payments

We accept all major credit cards and PayPal. Orders are dispatch upon payment being made in full.

Shipping Information

Shipping within Australia

Cookware orders are dispatched within 10 days and tracking will be provided directly to you. Shipping will be a fixed rate, which includes our packing costs.

Orders are shipped via Australia Post.

Once items have been shipped, they become the property and responsibility of the purchaser. If a product arrives damaged or is misplaced, it is the purchaser’s responsibility to provide details to Quiet Earth and liaise with Australia Post. We will provide you with all the necessary information to make your claim and assist where possible.

No refunds or replacements will be given for products missing in transit if the address provided was incorrect. Please enter your shipping address correctly as once it has been received, and your order dispatched we can not alter the address, and you will be charged the standard applicable postage rate to resend.

Shipping Internationally

Cookware orders are dispatched within 10 days and tracking will be provided directly to you. Shipping will be a fixed rate, which includes our packing costs.

Orders are shipped via Australia Post.

Generally, orders will be received within 20 working days, although certain destinations may take longer. 

Items shipped internationally are insured against loss or damage and this cost is included in your shipping payment. Once your order is placed and dispatched, it is viewed by Australia Post as your property. Any missing items or damages are the responsibility of the purchaser.

Duties & taxes

Please be aware that any items shipped internationally may incur additional fees and duties levied by customs. As the recipient of the item, you are responsible to pay any of the taxes and duties levied by the country you are shipping to. Your package will not be released from customs until these payments are made. Quiet Earth is unable to advise how much these duties will cost, please ensure you are aware of the cost of these fees before you make your purchase.

Faulty items & damages

Quiet Earth products are handmade using high-quality products and materials. Due to the manufacturing process, our items may possess imperfections, scratches or marks and any variations are intentional and part of the handmade nature, as no two pieces are exactly the same. It is likely the item you receive may vary from the supplied images on our site. We do not take liability for this and we ask you to welcome the uniqueness of the item you received. 

All items are thoroughly checked before sending and packaged with care. In the unlikely event that you receive an item that is damaged or broken, please contact us immediately on info@quietearth.com.au, providing images and details and we will review and correct if indeed found faulty. If your pot arrives cracked or broken and we no longer have any in stock, we will move forward towards a refund or store credit, sending out another pot once the insurance claim has been granted. This may take up to 30 days. Please note, if structurally your item is not affected, this will likely come under a natural imperfection and will not warrant a refund or exchange. 

Please Note: Faulty and damaged items are subject to the same conditions as returns and exchanges. If you receive an order which is visually damaged or opened insist that this is noted with the carrier before signing for your order. 

Quiet Earth does not take responsibility for any unforeseen circumstances that may occur in relation to OH&S (lifting heavy items, injury or damages to the consumer and or property from our products). Once your Quiet Earth order has been received, the consumer becomes fully responsible for any actions or outcomes in association with Worn product(s).

Changes to these terms

These terms are subject to change without prior notice

Refunds

We do not offer refunds, unless you receive a damaged item and we no longer have any more in stock. Your refund will be granted once the insurance claim has been approved.

We respect our right under consumer law not to offer refunds on orders because of delays caused by natural disasters or pandemics. Production delays are not grounds for refunds under any circumstances.

Copyright

You must comply with all proprietary and copyright notices on this Site. This Website is owned by Om Cade (ABN: 40197452981), and is subject to copyright. The information on this Site is protected under Australian copyright laws. Subject to provisions of the Copyright Act 1968 (Australia), you must not in any form or by any means:

A) copy, adapt, reproduce, broadcast, store, transmit, distribute, print, publish or create derivative works from any information or material on this Site;

b) alter, decompile, disassemble, reverse engineer or modify any material or information that you receive from this Site which 

can be accessed through this Site; or

c) use or apply, for commercial purposes any material or information on this Site, without the prior written consent of Quiet Earth.

All trademarks, brands and names appearing on this Site are the property of their respective owners.

Nothing contained on this Site should be construed as granting any licence or right of use of any trademark or part of any trademark displayed on the Site without the express written permission of Quiet Earth.

Credit card fraud

WhilstQuiet Earth employs the latest in Secure Sockets Layer (SSL) technology software for its transactions with our customers, Quiet Earth will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by a customer whose credit card is fraudulently used or is used in an unauthorised manner.

Force majeure

Quiet Earth shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond the reasonable control of Quiet Earth, and Quiet Earth shall be entitled to a reasonable extension of time for the performance of such obligations.

Governing law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Australia and shall be subject to the non-exclusive jurisdiction of the courts of Australia.
